Progress Dieselgate Matters

Emission Claim Foundation represents aggrieved car owners in cases against Renault, Mercedes and Stellantis regarding diesel fraud. With Renault, a crucial hearing is approaching in January 2024. In the appeal with Mercedes, the jurisdiction of the Dutch court is being discussed. Stellantis is awaiting a substantive hearing regarding tampering software. Courts award damages to VW owners due to sham software

Courts in Haarlem and Groningen have recently ruled that owners of Volkswagen vehicles are entitled to damages for the use of tampering software, supporting proceedings against carmakers such as Renault, Peugeot, Opel and Citroën. The European Court has previously ruled that breaches of emissions rules entitle owners directly to damages, increasing the likelihood of successful outcomes in these cases.

Positive interim court ruling for action against Renault in emissions claim case

The court in Amsterdam has given the green light to the action against Renault in the Emission Claim case, establishing the court's jurisdiction and recognising Emission Claim Foundation as a collective advocate. Under the old action law, Emission Claim Foundation will seek a collective statement of rights and a possible settlement with Renault for compensation of alleged damages.

Progress of lawsuit against Renault on emissions claims

Last summer, Emission Claim Foundation was the first to file a writ of summons against Renault, followed by two other initiatives, and the court has decided to divide the proceedings into three phases, with the first phase focusing on procedural issues and ruling expected on 8 February 2023.

Silent diesels, you have probably heard the term come up more often in recent years. It refers to cars - with a diesel engine - that emit more in practice than on paper. Now there is good news for buyers of one of the models, they are entitled to compensation, the European Court decides.

German 'sham-Mercedes' owner entitled to damages, European Court says

Mercedes-Benz must pay damages to a German motorist because the manufacturer had installed illegal software in his diesel car. As a result, it emitted too many harmful nitrogen oxides. As a result of the ruling, other victims may now also be able to file claims for damages.

Good news owners of shuttered diesels: are entitled to damages

According to European law, automobile manufacturers are obligated to provide buyers of a vehicle with a so-called certificate of conformity, which guarantees that the car complies with all regulations. This certificate also serves as protection for buyers against manufacturers who fail to fulfill their obligations, states the European Court. Therefore, violation of European legislation entitles buyers to compensation from the automaker.

Opel is required to recall 100,000 diesel vehicles due to cheating software

The German government has ordered automaker Opel to recall approximately 100,000 diesel cars. Earlier today, inspectors conducted raids at two facilities of the automaker on suspicion of manipulating test results of the diesel vehicles.

Peugeot, Opel and Citroën sued over tampering software

In France, Peugeot and Citroën are now facing criminal charges, while Opel recently reached a million-dollar settlement in Germany to avoid it. Volkswagen has awarded numerous damages in the US and Germany, but not in the Netherlands.

Mass claim against Renault over shuttered diesels

According to the foundation, Renault has set cars' software to make the cars appear much cleaner in official tests than they really are. 'In reality, those cars emit much more nitrogen than is allowed under European rules. As a result, people paid too much for the car and Renault has to compensate,' said Michael Bacon, a lawyer at Kennedy van der Laan.

New mass claim against Renault over Shomel diesels

Renault has been taken to court in the Netherlands over a new mass claim related to the diesel scandal. According to the Emission Claim foundation, France's Renault has been cheating on diesel emissions for years, causing the cars involved to emit up to 16 times the legally permitted amount of harmful nitrogen, according to the foundation.

Claim club demands money back from Renault for 300,000 Dutch diesel drivers

The Emission Claim Foundation wants to help Dutch citizens who own or had a diesel-powered Renault vehicle with build year 2009-2019 to get compensation. In doing so, the foundation is aiming for 20% of the purchase price, which should yield €12,000 in the case of a new Renault Espace and €6000 in the case of a Clio.
