The organisation

Emission Claim is an initiative of Stichting Green Claim. As a non-profit foundation, Stichting Green Claim assists people in the Netherlands who purchased or leased a diesel car fitted with emissions defeat devices in obtaining compensation.

Board of Directors

The Board of Directors of the foundation is responsible for the (financial) policies and the implementation of the strategy aimed at achieving the statutory objectives.

Supervisory Board

The Supervisory Board oversees the policies and strategy of the Board of Directors and the overall operations of the foundation. Additionally, the Supervisory Board provides advice to the Board of Directors. 

None of the board members have a conflicting interest with the foundation, nor any interest that could jeopardize their independence.

Stichting Green Claim has appointed the Amsterdam-based law firm Kennedy van der Laan to represent them in the Diesel Emission Cases.

Claim code compliance

The Stichting Green Claim complies with the legal requirements of Article 3:305a of the Dutch Civil Code and the requirements of the Claim Code 2019. The claim code is a code for foundations and associations engaged in representing collective interests. The purpose of the code is to promote that the advocate always puts the interests of injured parties first.

Organisation

  • The Stichting Green Claim board is responsible for the policy and implementation of the strategy aimed at obtaining compensation.

    Attorneys' fees are included in the success fee (maximum 25%) that the foundation is entitled to in case compensation is obtained.

Financial

  • The Green Claim Foundation is funded by Hagens Berman Sobol Shapiro LLP, a US litigation law firm experienced in suing companies for their wrongful acts. Hagens Berman is funding the proceedings and in return will receive up to 25% of the damages realised by the foundation. Any unclaimed amounts will be used in accordance with the foundation's statutory objectives.

  • Our board members receive a basic monthly allowance, as well as a compensation of €250 per hour for their services. They are also reimbursed for reasonably incurred travel, accommodation and meal expenses. With the exception of Steve Berman, who sits on the Board of Trustees on behalf of the funder, none of our board members has an interest that conflicts with that of the foundation or could compromise their independence. Mr Berman has waived the fees due to other board members.
